Just four days shy of an entire year, The Truck Incident has been fully resolved!
As you may recall, during the bike portion of Ironman Coeur d’Alene in June 2010, I was struck by a pickup truck being driven by a guy under the influence of alcohol and prescription medication. I retained the services of a local Idaho Law firm because the last time I got into an altercation with a motor vehicle while on my bike, I represented myself and the driver’s insurance company (Am Fam) screwed me over. Being two time zones away and unfamiliar with Idaho State Law, it seemed prudent to have someone looking out for me that knew what they were doing, even if it “cost” me a third of any settlement I’d be fortunate enough to get.
My people got in touch with his people and his insurance company (AIG), cut me a check for the replacement value of my bike in August of 2010. They then settled out of court for damages and I received another check March, 2011. The driver had only the minimum amount of coverage required by law so they didn’t offer much. Fortunately it was enough to cover all of my expenses for the three Ironman events I did in 2010, plus a bit.
Interestingly, while I was rehabbing my injuries, I had to file a no-fault claim against my own auto insurance policy (Acuity) to cover my medical expenses. Once I was healed, my Idaho lawyer filed an underinsured motorist (UIM) claim against Acuity. While this seemed excessive, my lawyer explained that because I had gotten a settlement from AIG, Acuity could (and likely would) file suit against me to recoup their expenses for my medical treatment. He strategy was to file against them for UIM as a bit of a proactive measure to prevent them from coming after me. He expected it would likely end in a “draw” and I’d be on my merry way without the proverbial insult-to-injury. Turns out Acuity, was more agreeable that we’d hoped. They waived the medical expenses and actually gave me a small settlement which I received in the mail today. I’m quite thankful for working with a great insurance company and makes me want to stay with them for a long time.
So even though getting through all three Ironman events last season was incredibly difficult and kinda sucked at times in dealing with the injuries, I fully realize how incredibly fortunate I am. I was able to finish all three, I suffered no permanent physical damage (outside of a scar on my ankle), I got a new bike, I earned some extra money, and I certainly got one helluva story!
